Money and Me Claims best claims company Terms and conditions

This document sets out the Terms and Engagement for the appointment of Money and Me Claims Ltd to act on the Clients behalf in all aspects of the administration and negotiation of the claim.

1. Definitions

1.1 Claim(s) means all the Clients claim or claims against the Company relating to the mis-selling of an endowment policy, mortgage, investment, pension or payment protection insurance policy or policies, or the application of unlawful charges to the account(s) of the client.

1.2 “Client” means the policy holder/account holder(s) whose details are set out in the Letter of Authority and who have appointed Money and Me Claims Ltd to provide the service

1.3 “Company” means the Financial Institution and or persons to whom the Letter of Authority is addressed being the insurance company, Bank, Building Society, Credit Card company or Financial Adviser or any other entity which sold the policy or gave the advice to the client, or applied the unlawful charges (including for the avoidance of doubt any employee, director, agents, representatives and associates of said entities or any other entity and or any of the predecessors)

1.4 “Compensation” means any sum paid or awarded as calculated at the time of the award that would not have been paid if the claim had not been made. Compensation is due on all sums that benefit the client including this includes amounts of compensation awarded to the client that includes reduction of arrears on any account the client holds with the company the claim is against. We must also make it clear that Money and Me Claims will not accept clients that are in a Trust Deed, IVA or Debt Management programme at the date of signing this contract unless it is in the clients best interests to do so and you must notify any third party of our involvement and also notify Money and Me Claims so we can send a copy of our terms of engagement to the third party for their approval which must be given in writing and confirm it is in the clients best interests for us to continue with the claim.

1.5 “Money and Me Claims Ltd” means this firm, a limited company and a third party claims handler, registered with number 06934350 having its registered office at 11 Smitham Downs Road, Purley, Surrey, CR8 4NH

1.6 “Fee” means the fee of 15%, payable to Money and Me Claims Ltd for the service carried out by it. For example if we recover £1,000 compensation, our fee would be £150 and you would receive £850. Another example would be the client is awarded £1,000 in total but the company the claim has been made against retains £500 for arrears and the client only receives £500 then the amount due to Money and Me Claims would be £150 and not £75 as the total claim was still £1,000.

1.7 “Letter of Authority” means the letter included in the claim pack to be sent to the Company from the client

1.8 “Service” means the services provided by Money and Me Claims Ltd including assessing the viability of, preparing, submitting and negotiating your claim.

1.9 Money and Me Claims will submit your Data Subject Access Request if required and will then audit your case for the potential of being mis sold, we will then prepare a report for you and submit a formal complaint to the company in question on your behalf if we feel it is appropriate to do so. We will also continue to peruse your claim with the relevant bodies if we feel it appropriate to do so, these include the FSA, Financial Ombudsman, Financial Services Compensation Scheme and any other body we feel appropriate to your claim.

1.10 “Terms” means these terms of engagement

2. Conduct of Engagement

2.1 By signing and returning the Letter of Authority, the client hereby agrees to be bound by the Terms and Conditions and appoints Money and Me Claims Ltd to provide the service for such period as to all Money and Me Claims Ltd to assess, and if reasonably possible, to complete the claim.

The Client Will

3.1 By completing and signing the Letter of Authority give Money and Me Claims Ltd his/her consent and full authority to deal with the Company on the clients behalf and to obtain relevant information from whatever source on a continuing basis

3.2 deal promptly with every reasonable request by Money and Me Claims Ltd for authority to deal with the Company on the Clients behalf and to obtain relevant information from whatever source on a continuing basis

3.3 promptly inform Money and Me Claims Ltd of any relevant matters affecting the claim

3.4 Notwithstanding such agreement, should the compensation be paid direct to the client, Money and Me Claims Ltd will invoice the client for the fee which will become immediately due and payable to Money and Me Claims Ltd. If this fee is not paid in full within 30 days of the dated invoice it shall be deemed a termination of the Agreement and will fall under clause 3.6 below

3.5 Give Money and Me Claims Ltd the right to deal exclusively with the Claim, unless otherwise agreed in writing by the client and Money and Me Claims Ltd.

3.6 If this Agreement is terminated by the Client for any reason, the cancellation fee will be based on the work undertaken at the point of cancellation based on an hourly rate of £100 per hour. Cancelation of this agreement must be made within 14 days of signing the terms of engagement and any cancelation must clearly specify which products are being cancelled. Cancelation must be in the form of written communication either by email our in writing. If work has commenced prior to cancelation been given then the client will be liable for the work and expenses of us which we be at the rate of £100 per hour.

3.7 for the avoidance of doubt not be liable for any charge in respect of the Claim if the claim is pursued and the company pays no compensation.

4. Money and Me Claims Ltd will

4.1 Rely on the information and document provided by the client to Money and Me Claims Ltd as being true, accurate and complete. Money and Me Claims Ltd will not audit, test or check such information or document excerpt where it is under legal obligation to do so;

4.2 use its reasonable endeavours to obtain the maximum compensation for the claims that are pursued

4.3 accept no liability for an unsuccessful claim or for the amount of compensation paid to the client

4.4 Promptly notify the client is the claim is not to be pursued. It is at Money and Me Claims Ltd sole discretion to decide whether or not to proceed with the claim at any time during the claims process but Money and Me Claims Ltd must act reasonably in taking such decision

4.5 promptly notify the client of the outcome of a claim

4.6 preserve confidentiality, including the clients personal information (even when this agreement has terminated and the client is no longer a client) save as expressly or implicitly authorised to the contrary including where disclosure is made at the clients request or with the clients consent in relation to pursuing the claim or where otherwise required by law.

Disclaimer

5.1 Money and Me Claims Ltd accepts no liability for any loss suffered by the Client by entering into this agreement and specifically in the event that no Compensation is paid to the client by the Company. Any claim by way of consequential damage arising out of any act or omission or commission by Money and Me Claims Ltd is specially excluded.

5.2 You are aware that you can complain to the Company at no cost, with the ability to take the matter further to the Financial Ombudsman Service yet still wish to pursue your complaint via Money and Me Claims Ltd

5.3 Please note that you have 14 days (which starts from the date you signed the authority) to cancel your authority, instructing us to act on your behalf.

5.4 Full details of Money and Me Claims Ltd internal complaints are as follows, in the first instance please contact the company by Phone email our in writing we will acknowledge your complaint within 5 working days. Your complaint will be reviewed by a member of staff who will inform you of the outcome of the complaint within 4 weeks or a holding letter to allow us to investigate further and after 8 weeks we will give you our final response. If you are not satisfied with our response or if we cannot resolve the complaint within 8 weeks you have the right to refer your complaint to the Claims Management Regulator, 57-60 High Street, Burton on Trent, Staffordshire, DE14 1JS or contact then by telephone on 0845 4506858 or you can email then at info@claimsregulation.gov.uk.

5.5 Money and Me Claims Ltd is Regulated by the Ministry of Justice in respect of regulated Claims Management activities our authorisation number is CRM21087

Governing Law

6.1 This agreement shall be subject to the laws of England, Wales and Scotland
